    These terms apply when you purchase digital artwork from Dark Cornwall.

    1. About us

    Dark Cornwall is operated by Dark Folklore Ltd, trading as Dark Cornwall Studio (“Dark Cornwall”, “we”, “us” or “our”).

    2. Digital products

    Our digital artworks are supplied electronically. You will not receive a physical product unless the product description expressly states otherwise.

    Before purchasing, please check the product description for:

    • The file type, dimensions and resolution
    • Any software or equipment required
    • The permitted uses of the artwork
    • Any limits on the number or size of prints

    Colours may vary between screens, printers, inks and papers. These differences are not considered faults with the digital file.

    3. Ordering and payment

    The price shown at checkout is the total price payable, including VAT where applicable.

    Your order is accepted when we send your order confirmation and make the digital file available to you. You are responsible for providing an accurate email address and ensuring that your device can receive and open the file.

    4. Permission to use the artwork

    When you purchase a digital artwork, you receive a limited licence to use it. You do not purchase ownership of the artwork or its copyright.

    Unless the product description states otherwise, you may:

    • Download and store the file on your personal devices
    • Print the artwork for your own personal, non-commercial use
    • Use a professional printing company to produce prints solely for your personal use
    • Display those prints in your home or give a printed copy as a personal gift

    You must not:

    • Sell, share, distribute, upload or transfer the digital file
    • Sell prints or products containing the artwork
    • Use the artwork for advertising, branding, merchandise or any other commercial purpose
    • Publish the full-resolution file online
    • Edit the artwork and claim it as your own
    • Remove signatures, watermarks or copyright information
    • Use the artwork to create an NFT or other blockchain-based asset
    • use the artwork to train, develop, test or operate an artificial intelligence or machine-learning system
    • Make the file available through file-sharing platforms, print-on-demand services or digital marketplaces

    5. Copyright

    All intellectual property rights in the artwork remain with Dark Cornwall, the named artist or the relevant copyright owner.

    Your purchase does not transfer copyright or grant permission to reproduce the artwork beyond the personal-use licence described in these terms.

    Where an artwork has been created by a contributing artist, Dark Cornwall supplies it under an agreement with that artist. The artist retains any rights identified in the product description.

    6. Download access

    Your download will normally become available immediately after payment. The order confirmation will explain how to access it.

    Please download and securely back up your purchase. We do not guarantee that download links will remain available indefinitely, although we will make reasonable efforts to help if you lose access.

    You must not attempt to bypass any download limits or security measures.

    7. Cancellation rights

    Digital downloads normally carry a 14-day cancellation period. However, the law allows us to supply the download during that period if you expressly request immediate access and acknowledge that you will lose your right to cancel once the supply begins.

    Before receiving immediate access, you will therefore be asked to agree that:

    I expressly consent to Dark Cornwall supplying the digital content immediately, before the end of the 14-day cancellation period, and I acknowledge that I will lose my right to cancel once the download or access to the digital content begins.

    Once access or downloading has begun following this agreement, you cannot cancel the order simply because you have changed your mind.

    If you do not provide this consent, we may wait until the 14-day cancellation period has ended before making the file available.

    This does not affect your rights if the digital content is faulty, incorrectly described or otherwise does not conform to the contract. These rules reflect the Consumer Contracts Regulations 2013 and current UK Government guidance for digital downloads.

    8. Faulty files and refunds

    Digital content must be of satisfactory quality, fit for its stated purpose and as described.

    If your file is corrupted, incomplete, incorrectly supplied or cannot reasonably be used as described, please contact us with your order number and a description of the problem.

    We may first provide a replacement file or another reasonable solution. Where the problem cannot be resolved, you may be entitled to a price reduction or refund in accordance with the Consumer Rights Act 2015.

    Nothing in these terms limits your statutory consumer rights. Further details appear in the Consumer Rights Act 2015.

    9. Unauthorised use

    If we reasonably believe that a file has been shared, resold or used outside the licence granted by these terms, we may:

    • Suspend further download access
    • Terminate the licence
    • Require the unauthorised material to be removed
    • Take action to protect the rights of Dark Cornwall or the relevant artist

    Termination does not prevent us or the artist from pursuing a claim relating to an earlier infringement.

    10. Our liability

    We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

    We are not responsible for losses that were not reasonably foreseeable when the contract was made. If you purchase as a consumer, we supply the artwork only for personal and domestic use and are not responsible for business losses.

    11. Privacy

    We process personal information in accordance with our Privacy Policy, available at [insert link].

    Payment information may be processed by our payment provider and will also be subject to that provider’s privacy terms.

    12. Changes to these terms

    The terms applying to your purchase are those displayed when you place your order. We may update these terms for future purchases, but changes will not retrospectively alter an existing licence unless required by law.

    13. Governing law

    These terms are governed by the laws of England and Wales.

    If you live elsewhere in the United Kingdom, you retain any mandatory protections provided by the law where you live. You may bring proceedings in the courts of the part of the United Kingdom in which you reside.
